Start with the actual UK position
Nitrous oxide has been controlled as a Class C drug since 8 November 2023 when it is, or is likely to be, wrongfully inhaled. Legitimate catering use, including whipped cream preparation, remains lawful. The Home Office guidance says ordinary legitimate use does not require a nitrous oxide licence. It expects suppliers to take reasonable steps so they are not reckless about supply for wrongful inhalation. Do not infer a blanket UK age limit or a special catering licence from overseas examples.
Questions to ask before ordering
- What is the exact product, gas quantity and intended culinary use?
- Which cream whipper, regulator or dispensing system does the manufacturer say is compatible?

- How will used cartridges or cylinders be collected under your commercial waste arrangements?
Keep purchase records and make sure employees use the manufacturer’s instructions for the equipment supplied. Larger cylinders and small cartridges may need different connections and handling; do not assume they are interchangeable.
What responsible suppliers should consider
The Home Office lists reasonable checks for retailers, such as the quantity ordered, circumstances of the sale and credibility of the delivery address. Online retailers should consider whether other purchased items suggest potential misuse. These are factors for judgement, not a fixed checklist that proves a sale lawful in every case.
